Video Surveillance In Work Place Is It Good Or Bad Video Surveillance In Work Place, Is It Good Or Bad?The loss of employee privacy rights in the workplace is a growing concern among employees, attorneys, and civil libertarian groups. Although employers in banks, telecommunications, securities exchange, in hi-tech industries, and in other workplaces justify using video surveillance in the workplace to monitor employee behavior to chiefly promote safety, improve productivity, and stop theft, protecting employee privacy must be a top concern. For if the courts find that the employer’s surveillance methods are less than fair, that firm may find itself knee-deep in lawsuits that could have been prevented.
Employers install hidden surveillance cameras for many good reasons (preventing theft, promoting productivity or protecting employees) that in some cases will intrude upon employee privacy. Legal observers and human resource specialists who study workplace privacy believe that employee privacy intrusions are more common than previously observed, and that they will increase every year.

According to a 2005 survey conducted by the American Management Association, more than half of the companies surveyed use video monitoring to prevent theft, violence and sabotage (51% in 2005 vs. 33% in 2001). In addition, the number of companies that use video surveillance to track employees’ performance has also increased, with 10% now videotaping selected job functions and 6% videotaping all employees. Among firms that use video surveillance, 85% notify employees.

As more and more employee groups become aware of how they are being watched, the more likely they will take their employers to court.

These are the four main types of court-upheld privacy violations that could occur in stores, factories and offices and the first type is directly related to video surveillance.

• Intrusion upon seclusion which includes invading worker privacy in bathrooms and changing rooms

• Publication of private employee matters

• Disclosure of medical records

• Appropriation of an employee’s likeness for commercial purposes

In addition, video surveillance must be limited to visual images and cannot include audio in order to comply with federal and state statutes.

Employers need to be proactive and aware of these four privacy violations so that their employees’ individual rights are respected and protected.

How to achieve balance between monitoring and intruding upon employees

First, the employers need to clarify what privacy rights employees are guaranteed and what constitutes an invasion of privacy. Then, employees must be notified in writing that surveillance will be conducted and they should also sign a waiver verifying that they know they may be monitored.

Management must define what is acceptable supervision versus “snoopervision” and that includes not videotaping showers, restrooms, changing rooms, smoking areas, and employee lounges. These are places specifically for employees’ personal comfort, health or for safeguarding their possessions. However, employers must also be sensitive against using video surveillance in other areas where employees might takes breaks.

Employers must be fully aware of the privacy risks associated with videotaping employees so that the likelihood of litigation is reduced. Companies should also nurture a workplace environment where employees can voice privacy or security concerns in confidence with management without feeling that their conversations are being monitored. In short, if employers choose to use video surveillance in the workplace, they must adhere to written privacy guidelines that will keep employees secure and that will also respect their privacy.

The theory on ‘whistle blowing’ is that the individual is helping the community, and following their ethics, by reporting the offending person or company. The risk of recrimination is very high and usually results in a long and difficult fight for the whistleblower. This battle will likely including legal threats and character assassination.
So what can you do to protect yourself when you do blow the whistle? Having been through this process I have gain some insight on how best to handle the situation.

1. Documentation: Once you suspect that something is wrong you should begin documenting. Start by taking notes in a log book or note pad. This information will be helpful when you need to tell your story and will provide the detail needed to track down further evidence of wrong doing. Next, start collecting pertinent documents. The best way is to copy documents (photocopy, computers docs, etc.). When you think you have enough, double it. Pictures, phone recordings, documents, conversations, e-mails are all important and should be noted when possible. There can never be enough documentation. Once the authorities begin investigation documents had a tendency to disappear.

Many people who don’t know the laws will try to tell you that these methods are illegal. The fact is they are not. In Canada it is legal to record a conversation or phone call as long as one of the parties is participating in the conversation. The removal of documents from the workplace is a gray area. Under normal circumstances removing company information is illegal, however when it is evidence it can be collected. In a Canadian court all evidence will be considered. Check with your governments laws or speak with a lawyer before taking any risks.

2. Minimize Your Exposure: When you draw up the courage, and support, to finally report the issues there are a few things you need to do. First, it is best if you stay at your job while you report the issues. Sometimes the authorities will ask you questions, that will help them with their investigation, and being at the location is beneficial. Ask to be kept anonymous, if possible, but sometimes this can’t be done. Next, get your resume polished up and start sending it out. Then prepare financially by locating your employment insurance office. Tell them that you are blowing the whistle on your employer and you may be fired for it. Provide the person with the contact names of whichever authority you contacted. The idea is to build a repour, so if bad things happen, people will know the facts. Don’t loose that all important safety net.

3. Go with your Instincts: Most people will tell you not to blow the whistle because there are no winners. They are partially right, but without your courage people will get hurt, the rich will get richer and abuse their powers. You can change that by doing what you feel it right. We often cloud our thinking with other peoples perceptions, but only you can determine what to do. Most of the time your instinct are right and you should trust them. If you listen to others and they convince not to go with your instincts, and then something bad happens, you have to live with the consequences, not them.

4. Be Patient: Nothing happens quickly no matter how fast you want to be done with it. The reality is that things will go much slower than you ever expected them too. The best way to make sure things are moving is to do some research. For example, if you file a complaint against a medical professional, the regulatory College that receives the complaint will have a complaints process. However, this is usually regulated by a government agency that has legislation regarding complaints. In Ontario all complaints must be handled in 120 days. If not, you can contact the Health Professions Appeal & Review Board and they will contact the College and accelerate the process.

Some other tips to accelerate the process include contacting your local politician, begin a letter writing campaign to media outlets and compiling your story onto an internet site. Be persistent when dealing with each agency, don’t accept their statements at face value and always follow up.

5. The Media is Not a Solution: They can help but you have to convince them to write the story. Many times it may take months for them to move. Remember they don’t want any liability, they are a profit motivated company and will only publish story’s that make them a dollar. If your former employer is litigious, they will probably be too scared to publish. The media has no problem reporting history, so once a final verdict is reached, by the authorities, they will write a story. Unfortunately it will be to late to help you.

Some of the smaller media outlets may be more willing to help you. Take a look at freelance writers, who may spend more time working on your story and getting the facts. They also have the contacts you need to get it published.

6. Prepare for an Attack on your Character and Legal Threats :: The person or company you are dealing with will not let things go easily. The first response will be to discredit you. If you look like an disgruntled employee or someone with a vendetta then your story will be less believable. It’s easy for the person or company to do this. If they were unethical to start with, it’s not a huge leap for them start lying about you after you report them. There isn’t much you can do except try to disprove they’re statements. Use the document you gathered to clearly show that they are the guilty party and you were just being ethical. In the end your efforts will be recognized. You will probably receive a cease and desist letter, don’t be overly concerned as this is most likely posturing. If you are worried, speak with a lawyer.

7. Use Lawyers Sparingly: Nobody can fight with the passion you have and no lawyer will ever put the amount of effort you already have into your fight. Replying to a cease and desist letter is easy, just stick with the facts, provide the evidence and take the high road. Most lawyers will act like an 600 lb gorilla, your job is to be bigger. In all likelihood they won’t want to take this issue to a public forum, like a court room, especially if you have documented the case very well. That would give you a perfect opportunity to invite the media and lay your case out. Examples of cease and desist responses can be found at Snake Oil

If you need legal advice, get it, but don’t let the lawyer bleed you dry. Have your questions prepared on paper and sit down with the lawyer and discuss the issue. If they charge a minimum of one hour time, use it all. One good thing to do is prepare a short summary of the facts in your case, and fax it in to the law office. Don’t ask question in the letter. Blowing the whistle is stressful enough without having thousands of dollars in legal fees.

Some people will tell you not to let the event consume you. If it does consume you, it will affect other parts of your life. But sometimes focussing your energy can be better if it will resolve the issue quicker. It’s better to throw your whole heart into the matter, rather than fight with yourself. It is difficult to not be consumed. My advice is to simply go with it. The harder you work the quicker the issue will be resolved and the sooner you can get on with your life.

The is no reward for doing a good deed, that’s only in movies. In the end however you should have the satisfaction that you made your community or country a better place. People will respect you for your efforts and hopefully inspire then to do something good and that is a reward in itself.

Not the type of yelling that someone does when you’ve done something to tick someone off, but the kind of yelling that was a swift kick in the pants about something that I’m NOT doing.
I probably deserved it. I needed to hear it. But it made me edgy and I tried to make excuses.

Nope! That didn’t work. I continued to get the lecture.

Now I know you are all dying to know what I did that wasn’t exactly right. Mary? Got yelled at? How DARE they?

Here’s what happened. Tonight my husband and I met out a friend from swimming and a woman I set him up with on a blind date. Lets call him Bill. If you read the entry that he dances to his own tune, then you’ve met Bill.

In my book, he’s a consistent and dedicated swimmer. The lecture was about the fact that: I’M NOT.

I miss practice. I get there a tad late. And, I miss practice.

I told him I HAVE A LIFE. I have a child! I need my sleep!

He reminded me that I have a goal. I want to make nationals. I want to lower my time. I’m pretty close to doing it too.

So, here I am at 3 in the morning writing about the fact that I got yelled at. And I think it worked. I know he’s right and I’m going to change my schedule around a bit so I can make the practices more often. I was going to about 3 a week instead of 4.

Earlier this week I dropped a note to friend who is an entrepreneur. He and his partner had a yelling match on the phone. I know them both well and they’re both working hard at building their business. They had a disagreement and I tried to help smooth over the conflict.

I got this email from my friend that I liked:

Mary: Thank you for your insight….Every tree that yields fruit must be shaken to get the best from the top.

So, I thought about it for a while and realized that the conflict did shake things up. It got them both out of their comfort zone. It made them think about what really was the answer to their problem. Because they didn’t dance around the problem and play nice they were able to solve the issues more quickly.

I’m always the type that wants to avoid conflict. I think that a lot of people are like me. Its easier to talk things out than yell and get to the bottom line. But I see how that works.

Now I’m not proposing that anyone else should go out and confront anyone just to be able to yell at someone, but I do think that honest confronting can be exactly the thing to make someone step up to the plate, take ownership and pull their weight or change some sort of negative behavior. It’s sometimes quicker than having discussion after discussion. It’s certainly more memorable. And sometimes, it can get you up at 3 in the morning to blog about it!

But lets just SEE if it’ll get me out of bed for 5:30am swim practice more times a week! I’m betting on YES.

Among many things, Donald Trump is a successful businessman and an extremely wealthy individual. Donald Trump is perceived by the mass public as a true corporate King. The question is who are all these people that competed so fiercely against each other during the hour that the Apprentice show was broadcasted and why did they strive to prove their skills so as to secure their position in his empire? One might support that they are the products of America’s powerful media networks, the gladiators of our postmodern reality. But are these reality shows we tend to watch ritually, the mirroring of our contemporary culture, or are they the outcome of today’s spectators’ confusion regarding the prevailing notions of modernity, revolution and self-development?
To be a citizen of the modern world, is equivalent to remain open to change and evolution, to be able to explore and create, accept or reject, all those forces and trends that shape the global scene and the mere self at the same time. This ongoing change, the development of human history, has been classified according to scholars as the act of relating modernization (the socio-economic process) with modernism (the cultural vision), through modernity (the historical experience). But this powerful process, although once considered linear, has evolved over time to the point that it can now be conceived as “”curved,”" since modernism has experienced a major decline during the 21st century. This realization can be partly explained by the fact that social, political, or economic revolutions have ended, while the upcoming reformations are not fostered by the bourgeois engagement, but mainly by the continuous technological progress limited to specific time fragments which make any kind of revolution seeming obsolete.
If then we accept that modernism has ceased to exist then what exactly are we left with? How can we identify ourselves in this endless game of change and evolution? The answer is hidden in the method used to analyze the present living circumstances and humanity’s past actions. Postmodernism or post-historicism, is another generic title given to the period after modernism, in order to characterize a shift in mentality, methods, and processes used by society to deploy a new system of reference. Having to deal with an almost static capitalistic scheme that blocks the likelihood of any profound cultural renovation comparable to the great Age of Aesthetic Discoveries in the first third of this century, society is left to revolutionize itself through the ruins of the past, equipped with the belief that a true revolution would be to abolish modernity as a whole.
Where is the Apprentice show on this check board? Is it the King, the Queen or the soldier in this game of power and control? Various arguments may be raised to answer such a question, but the underlying truth is that television, along with other technological innovations of the 21st century, like the Internet, have succeeded in becoming a new type of artistic expression, where the spectator has no intention to classify and analyze what is seen using specific labels, since their existence is considered temporal. The threat is hidden on the simple fact that the majority of the viewers, regardless their age, as the citizens of this global village, remain almost indifferent to these alterations in the scenery of life and consume these preheated meals without questioning their source while sitting in front of a TV or PC screen, unable to resist the magical world of consumption, misinterpreting it as the best solution available in this chaotic mode of living. It may seem pessimistic or oversimplified as a view, but Apprentice, Big Brother and many of these reality shows, are actually an analysis on the cultural shift of today’s societies, towards an epoch whose title has not yet been articulated.

While employees should believe that the decisions taken by the employer would be in their best interest, employers should believe that employee’s work ethics are only for the development of the organization.

You get an offer to become an “Executive Assistant” in an aluminum siding company. You visit their representative, and look over their literature, handsome colored brochures which proclaim opportunity, opportunity, and more opportunity. But, nowhere are benefit packages mentioned, the usual, medical, vacation, sick leave, termination pay–nothing of this in writing. But, the rep speaks lavishly of these “benefits.” You are impressed, join the team, find you are only to collect commissions for selling aluminum siding, work a few weeks, get disgusted and quit.
When you go back to collect your pay, you are told that you were never an employee, but an independent contractor, and delay excuses are made for not having your limited earnings available yet. You wait. Next time you try to contact them, you find the tent has been pulled and the company is gone. This is a pattern that is practiced repeatedly, and with much success, by con men everywhere.

Why this pattern?

Because it enables them “cover,” a means by which they can hide behind an advantage to them, a differentiation problem that the politicians are too cowardly to solve.

Congress has punted on this due to the difficulty of precise language and because, generally, employers everywhere want to keep the language vague so as to give them more maneuvering room in taking on additional help. These companies assert lobbying pressure against precise language. Some states have laws, but mostly subject to interpretation all over the map. End result? You are caught in the middle.

Only the IRS has rules covering this debate, the exact nature of which are unknown, but as a general rule run something along this line:

To qualify for independent contractor status a company must not provide any tools to work with. Example: when you call a plumber to come fix your sink, he brings his own pipe wrench. You do not provide this for him. You can only supply merchandise which will be used up in the process of the job, e.g. tissues to wipe down the plumber’s tools while he is working. The company may not specify work hours. That must be left up to the independent contractor, like the plumber. No other form of guidance may be exercised. You, as the customer, have engaged the plumber to attain a desired result, a workable sink, that’s all. The means of getting this desired result must be left up to him. And, importantly, the independent contractor must not be provided work facilities on a regular basis. This is yet another separation criteria in determining, is this person an employee or an independent contractor? To top off: an independent contractor submits invoices for services (he works for others beside you). And, employees do not submit invoices.

So how do you protect yourself against these charlatans?

Ask them to write down the work “benefits” they offer, maybe because you wish to ponder them, and / or, talk them over with family and friends.

Have them clarify, in writing, the status of an “Executive Assistant” as opposed to Sales Representative.

Ask for a list of references from satisfied customers. Ask for bank references.

You won’t have to go much further than this. If these simple requests are filled for you, this opportunity might be worth further pursuit.

If not, well, you’ve saved yourself a lot of time, effort. And, needless frustration.

The Dominion of Melchizedek, a totally fictitious, sovereign nation was located on an uninhabited Stoll owned by the Republic of Marshall Islands in the Atlantic Ocean,, off the coast of Columbia, South America. President of this island nation was the son’s wife, who reportedly lived in California. It was purportedly a quasi-religious society governed by a “House of Elders.” It had a complete financial system with phony banks and stock exchanges. It sold citizenships, insurance and stock licenses. It sold diplomatic passports, religious grants, business licenses.. And, it had an embassy listing in Washington, D.C., Unbelievably, it was actually “recognized” by an African state. (One can only question what these officials were smoking at the time.) This mighty little nation even had the boldness to declare war on France for nuclear testing. (The mouse that roared?)
The sum of the Dominion’s activities ran amuck. Cataloged by John Shockey, former U.S. Comptroller of the Currency, these included: taking deposits, investment sums and fees, and issuing worthless “guarantees.” Also, making loan commitments, verifying and “authenticating” values of other Melchizedek entities which issued hundreds of millions of dollars in worthless debt instruments which were used to obtain real money loans and were exchanged in real brokerage houses for real value securities.

Amazing is the fact that–despite excellent, detailed exposure in articles run in Forbes, the Washington Post, and the Wall Street Journal as long ago as the early 1990s–this monumental scam is still up and running, more than 15 years later. The Dominion’s website was clickable as of press time of this News Release. Endless? Limitless fraud? On and on, into perpetuity? Where does it all end? Or, does it? one might ask.

Breakdown of the system in its ability to restrain giant scams seems to be the key to success for this con man’s dream. In his book, Six Hours Past Thursday (visit the site), author, Jack Payne, goes one application better. “This nation-building exercise is entirely illegal,” says Payne. “It’s blatant, in-your-face, outright crime. From the opposite side of the fence my book tackles another broken system,” he goes on, “our cumbersome, snail-moving legal system. Converse to Melchizedek, this system is rife with opportunities for entirely socially acceptable, non-jailable ‘legal’ crime.” His novel weaves the story of how a Chicago mobster, with the aid of a con man, creates such an entity, a gambling island Mecca, ala Monte Carlo, off the coast of Florida.

“From fiction to reality! How close the gap?
Really! And, when you have no moral compass with which to navigate,” concludes Payne, “the sky is your only .limit.”

Kind of like a recovering alcoholic going down the liquor isle to go smile at the selection of beers knowing he’ll never buy one, but guilty just for looking. There I was reading the information for one of those Internet get rich quick programs, thinking about different dubious ways I could make it work.
Of course, I didn’t buy it, but the lure of fast cash and little work started appealing to me somewhere between the words “automated system” and “get paid daily” my eyes glazed over and a wicked smile crossed my lips. I actually started breaking down the numbers, that’s how bad I got: “well if I can just put 15,000 people onto a landing page and they convert at half a percent for a 3,000 dollar product . . .”

I’d been on a content bender, and I needed to escape. I’d written and edited somewhere between 100,000 and a million words that week and I was looking to relax. Most of us who have been on the Internet for any length of time know that those programs, while not scams (semantically speaking), are simply money games designed to quickly help the newbie E-marketer part ways with their money in a desperate search for quick cash and the promise of a new life.

Most of us found Internet marketing the same way.

We get duped.

I did, maybe you did.

Some people are broken from the experience, others continue buying into every scheme and money game they can get their hands on, and others actually try to figure out how the Internet works. For me the epiphany came somewhere between Godin’s Purple Cow and Levinson’s Guerilla Marketing when I realized I was on a snipe hunt for the holy grail.

There’s money to be made in the: “There is Money To Be Made Market.”

But it isn’t the kind of money I want.

That’s e-blood money.
