Here is another video of Andrew Lo seen on Fox Business News. This video discusses whether the Obama administration is targeting hedge funds unfairly right now. Lo believes that the US government is serious about regulating hedge funds but at the same time hedge funds are not at the center of this crisis and they are at the center of the solution to this crisis.

Hedge Fund Operational Due Diligence Question ListBelow please find a list of of questions which may be asked during an on site due diligence visit by a consultant or fund of fund. We have just added this list to our Hedge Fund Due Diligence Tool.

a) Verify the business location is as stated in the legal documents.
b) Meet all of the principals, PMs, analyst, operational staff, etc.
c) Verify all internal groups operate accordingly. (technology, accounting, operations, trading, risk, research etc.). Walk through the entire trade process: Trade generation, execution and processing, reconciliation, accounting, database and systems administration etc.
d) Verify the Disaster Recovery site is operational and working. (When was it last tested? How often does the manager use it? Does the manager have a DR plan? If so get a copy of it, how was the manager affected by key events, such as 9/11 and the 8/14/2003 blackout, other business continuity planning, etc.)
f) Does the manager have a non-investment group that provides control oversight in an open and transparent manner?
g) Verify that the working relationships with service providers are fluid and work under stress.
h) Verify that other investors are also sophisticated investors. (you will certainly feel more comfortable if other investors have preformed their OPDD)
i) Develop an overall assessment of the team and infrastructure
j) Does the compliance environment include documented policies and procedures for all relevant areas (soft dollar, personal trading, trade allocations, etc)? (Ask for a copy of the compliance manual.)
k) Verify cash controls and movements.
l) Develop a list of likes and dislikes.
m) Portfolio administration: Does the manager use Advent, Advisorware or some other recognized software application, or are they using Excel? The software used is critical because robust software can reduce fail points and errors.
n) Does the manager rely on service providers for NAV accounting?
o) Does the manager have an independent set of books and records reconciled to the prime broker?
You should ask to see redacted key trades – let’s say the fund discusses a drawdown of 7% in February and a 21% peak in March you want to verify those trades actually occurred internally and with the Prime broker and the fund administrator.
p) Does the manager plan on trading new instruments?
q) Is the manager experiencing employee turnover?
r) Is the manager planning on making any material changes to management, administration, the strategy or key personnel?
s) Is the manager or any key personnel the subject of any governmental or regulatory investigation?
t) Does the manager have an experienced non-investment leadership providing oversight of internal processes and service providers?
u) Does the manager have a consistent and well – documented valuation and pricing process, if so ask for a copy.
v) Does the manager have an external administrator providing full service support including daily trade capture and reconciliation to prime broker?
w) Does the manager have a dedicated operational team with well defined procedures and processes?
x) Are cash movements and account openings authorized by a single signature?
y) Is the back office subject to key man risk due to being understaffed?
z) Verify the accuracy of the historical data (compare it to cleansed data – I’ve seen a PM show a profitable trade but when I took a closer look at the data it was not remotely close to what the market actually traded on the date in question.)
aa) Verify that the firm has followed its Business Plan.
bb) Does the manager provide annually audited finical statements for the considered funds?

Hedge Fund Investment Returns | 2009Here is a short article excerpt from Bloomberg noting that hedge funds have just recently posted back to back positive returns over the past two months. This is the first time that this has happened in 8 months now – one of the first positive signs for the industry since early 2008. Here is a excerpt from the article:

Hedge funds posted their first back- to-back gain in eight months in January, rebounding from record losses in 2008 as North American managers benefited from betting stocks would fall, an industry report showed.

“I think what this is showing is that hedge funds have managed to shift their portfolios and they are effective in the current market conditions,” said Jennifer Carver, Hong Kong- based Asia chief executive officer at 3A SA, the alternative investment arm of Geneva-based Banque Syz & Co., that manages $3.5 billion worldwide. “We’re seeing a difference of what’s happening in the equity markets and bond markets and what’s happening in hedge funds, which is what should happen.” source

Bond markets are volatile, and cash, while strengthening, has been in a funk for the past four years. These three investments are the standards, but their behavior has shown that any investor overlooking alternative investments is missing out on real profit.
Alternative investments include hedge funds, but also cover futures, real estate, commodities and derivatives.

These sectors all share characteristics that earn them the name alternative:
- they tend to have high minimum investments
- less regulation
- less publishing or advertising of performance data
- high fee structure

Many alternative investments are managed like mutual funds (hedge funds, private equity funds). And the biggest advantage? Alternative investments don’t follow the market: commodities tend not to, and funds are designed not to. It’s a well established correlation. So they’re excellent insurance against market downturns. Many managers recommend alternative investments should be around 10 percent of your portfolio.
The structure of alternative investments can turn away small-cap investors, but commodities like precious metals are still available.

FRM Credit Alpha has published a prospectus for admission of the company’s shares to the official list and to trading on the main market of the London Stock Exchange. At the same time it has made an offer for subscription of C shares to be issued at £1 for each C sterling share, €1 for each C euro share and $1 for each C dollar share.

FRM is hoping to generate significant returns over cash, with low volatility and beta to global credit markets, when measured over a market cycle. The portfolio comprises between 12 and 25 specialist credit hedge funds using fundamental research, asset allocation, security selection and activism to invest in credit securities.

Both FRM Investment Management and Financial Risk Management are part of the FRM Group, founded in 1991 with approximately $15 billion in funds of hedge funds assets under management. Read more…

 Hedge Fund CertificationLast week the Hedge Fund Group (HFG) began to offer the Certified Hedge Fund Professional (CHP) designation program. The CHP Program is a two part designation. Level 1 ensures that participants have mastered a broad foundation of hedge fund industry knowledge across 6 learning modules. Level 2 allows participants to specialize in a niche area of their choice such as due diligence, prime brokerage or marketing, sales and investor relations. The program is now open for registration to 100 participants after which point it will close to new entrants for 6 months while the website and FAQ related resources are improved.

Hedge Fund Marketing License Question

“What license(s) are needed to market hedge funds as a third party marketer?”

Our answer:

We cannot provide legal/financial advice at all via email but I do know that some of us are required to hold our Series 7 and Series 63 to perform this type of sales work – this will probably vary based on your CCO or sponsoring broker-dealer. I believe part of this answer might also depend on the types of funds you represent. Hope this helps.

As noted within the answer above this is no form of compliance or regulatory advice, just an example of what licenses some third party marketers are being required to hold.
